The Parties agree that this choice of law, venue, and jurisdiction provision is not permissive but mandatory. You waive the right to any objection to the venue, including asserting the doctrine of forum non conveniens or similar doctrine.
ASSIGNMENT: This Agreement, or the rights granted hereunder, may not be assigned, sold, leased, or otherwise transferred in whole or part by You. Should these Terms of Service, or the rights granted hereunder, be assigned, sold, leased, or otherwise transferred by the Owner, the rights and liabilities of the Owner will bind and inure to any assignees, administrators, successors, and executors.
SEVERABILITY: If any part or sub-part of these Terms of Service is held invalid or unenforceable by a court of law or competent arbitrator, the remaining parts and sub-parts will be enforced to the maximum extent possible. In such a condition, the remainder of these Terms of Service shall continue in full force.
BRI Insights, along with its sponsors and all affiliates, are not entitled to any sudden, direct, indirect, punitive, exemplary, special, consequential, or any other unwanted damages happening due to or through any way by using our research.
As a customer, you have to ensure you will not be involved in any reselling of the data, report, or even a part of it, which you receive in your inbox from our company, in any way that may give rise to the possibility of competition with the kind of services and products provided by us. If you want to meddle in such situations you need to write a letter asking for permission to BRI Insights and can only do the same after getting the permission.
BRI Insights will not hold responsibility for any kind of loss you face by any chance, directly or indirectly, when the data or report is delivered late due to unavoidable circumstances. It can be due to natural calamities like floods, earthquakes, or situations like labour strikes, riots, government regulations, wars, embargoes, or any other new regulations. The time of delivery may get disturbed during this time, and a good delay may be expected.
You will always have to send a purchase order, in which you need to accept the quotation provided by us, along with an offer to sell. If you fail to send an acceptance in writing, which is not accepted by some authorised officer of BRI Insights, it will not be entertained. Suppose you make any alterations in terms and conditions, documents, or anything else in the purchase order, or submit things different from what was asked of BRI Insights. In that case, it will be regarded as cancelled, null or void. The quotation accepted here will hold no importance here. All the terms and conditions are fixed, and any changes will call for direct cancellation.
As per the set delivery format of the research studies operated by us, we under no condition do not favour refunds. Although you can ask for additional analyst support to clear any confusion after the purchase.
It is not within your right to terminate the contract, which has been curated after acceptance of the offer, in which you have agreed to pay the complete payment to conduct the research.
